Terms of Use

These terms apply when you use the MotherBotanist website, client portal, and app. MotherBotanist is a brand of Ramayrat Ventures, Inc. Plant care services also need a separate written service agreement.

1. Agreement to these terms

Ramayrat Ventures, Inc. ("Ramayrat Ventures," "we," "us," or "our") operates MotherBotanist. These Terms of Use apply to motherbotanist.com, the MotherBotanist client portal, and the MotherBotanist app (together, the "Services").

When you use the Services, you agree to these terms. If you use the Services for a company, you agree for that company. Do not use the Services if you do not agree.

2. The Services

MotherBotanist provides on-site plant care for offices. We serve San Francisco, San Mateo, Redwood City, Palo Alto, Santa Clara, and San Jose, California.

A written service agreement controls each plant care engagement. If the service agreement and these terms do not agree, the service agreement controls.

3. Quotes and pricing

Our website shows starting prices. Plans start at $2,500 per month for one on-site visit each week, for 1 to 2 office floors. The price for your office depends on its size, the number of plants, and the visit schedule.

A quote is not a contract. A price becomes final only when both parties sign a service agreement. Prices on the website can change without notice.

4. Client portal accounts

  • We give portal accounts to clients and to the people that clients approve.
  • You must give accurate information and keep it up to date.
  • Keep your password private. You are responsible for activity in your account.
  • Tell us at once if you think that someone used your account without permission.
  • We can suspend or close an account that breaks these terms or that puts the Services at risk.

5. Care records and photos

We create photos, care logs, and notes when we care for your plants. We use these records to provide the Services and to show the care that we gave.

Your company can see and download the records for its office in the client portal. We do not use photos of your office in marketing without your written permission.

6. Plant information

The Library and other plant information in the Services are general information. Plant needs change with light, temperature, and other conditions. Some plants can harm people or pets if eaten. Ask a qualified expert before you act on plant information for health or safety reasons.

7. Rules for use

Do not:

  • Use the Services against the law or to harm another person.
  • Try to get into accounts, systems, or data that are not yours.
  • Upload viruses or other harmful code.
  • Interrupt or overload the Services.
  • Copy, scrape, or resell the Services or their content without our written permission.
  • Send false information through our forms.

8. Our content

Ramayrat Ventures, Inc. and its licensors own the Services and their content, including the MotherBotanist name, text, design, and software. You can use the Services only for their intended purpose. These terms do not give you other rights to our content or brand.

Some photos on our website come from Unsplash and belong to their photographers.

9. Third-party services

The Services use third-party services, such as form, hosting, font, and photo providers. The Services can also link to other websites. We do not control third-party services, and we are not responsible for them.

10. Disclaimers

We provide the website, portal, and app "as is" and "as available." To the extent that the law allows, we disclaim all warranties, express or implied. This includes warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be free of errors or interruptions.

The service agreement sets out any promises about plant care services.

11. Limits on liability

To the extent that the law allows, Ramayrat Ventures, Inc. is not liable for indirect, incidental, special, consequential, or punitive damages. This includes lost profits and lost data.

For claims about the website, portal, or app, our total liability is limited to $100. A service agreement can set a different limit for plant care services.

Some places do not allow these limits. In those places, the limits apply as far as the law allows.

12. Indemnity

You agree to defend and pay for claims against Ramayrat Ventures, Inc. that come from your breach of these terms or your misuse of the Services. This includes reasonable legal fees.

13. Governing law

The laws of the State of California govern these terms, without regard to conflict-of-law rules. State and federal courts in California have exclusive jurisdiction over disputes about these terms. You and we agree to the jurisdiction of these courts.

14. Changes to these terms

We can change these terms. When we change them, we update the effective date at the top. If you use the Services after a change, you agree to the new terms.
